First, it is important to understand how we got here!
The 2018 Farm bill created distinctions between marijuana and hemp on a federal level. This definition created a distinction between two types of Cannabis: Marijuana and Hemp; Marijuana remains a Schedule I drug, and Hemp becomes “any cannabis plant, or derivative thereof, that contains less than 0.3 percent delta-9 tetrahydrocannabinol (THC) on a dry weight basis.”
This is why, for the last few years, you’ve been able to purchase cannabis products, without North Carolina being a “legal marijuana” state. This has provided North Carolinians access to safe, lab-tested cannabis products, as well as spaces for thoughtful and honest education (like Cannabliss!).

What this actually means is that the amount of Delta-9 in a hemp product is dependent on the weight of the product. Let’s compare two of our edible products:

While the 2018 Farm Bill has led to lab-tested, safe cannabis options, unfortunately, because of the “dry-weight basis” law and a lack of clear regulation, manufacturers started making products heavier, allowing for more and more Delta-9 per serving. Ultimately, this has lead to some bad actors doing things like:

Packing 1000mg into a single edible (unnecessary and unsafe, in our opinion)

Misleading consumers on the types and amount of THC in their edibles

Spraying CBD flower with distillates like Delta-8 or THCP

Selling to people under 21 and using branding marketed towards children
Justifying the decision due to the lack of regulation and inconsistencies in products, on November 12, 2025, the US government passed legislation that legally changes the definition of hemp to “any cannabis plant, or derivative thereof, that contains less than 0.3 percent Total THC Concentration on a dry weight basis” AND “final hemp-derived products containing no more than 0.4 milligrams of THC per container”.
This definition change may appear to be a small wording change, but it has MASSIVE impacts. This wording would remove about 95% of the hemp products currently in the market.
Why though, you ask?
THC is a broad definition for a group of cannabinoids with similar molecular structures. There are many different types of THC like: Delta-9 (the traditional THC we associate with cannabis), Delta-8, THCV, THCA & more. The 2018 hemp only defined parameters for Delta-9 THC and not the rest. This is what allowed for THCA flower to be sold (THCA converts to Delta-9 when heated, but isn’t above the 0.3% Delta-9 threshold at the time of sale, wink). The new 2025 definition includes all of those THC types- psychoactive and non-psychoactive.

To explain further, let’s look at those gummies from above again:
So, you’ve accepted that your favorite THC products will no longer be available. But at least there’s CBD, right?
Most CBD products on the market are Full Spectrum, meaning they contain plant compounds in addition to CBD, like terpenes, flavanoids, and other cannabinoids, like Delta-9. This is because cannabis research shows that when we consume all of these compounds together in harmony, we get better results (known as the Entourage Effect).
